Killer of San Francisco teen facing assault weapon charges after latest arrest for home invasion burglary

A killer who gunned down a San Francisco teen in 2016 has been arrested again, accused of being armed with an assault weapon during a home burglary.

Peter Milyak, 27, will appear in court today for a preliminary hearing after an unhurried police investigation into the November 2024 incident in which he and two others are alleged to have broken into an Excelsior apartment.

Prosecutors say he was linked by DNA to a 7.62mm Micro Draco assault pistol, fitted with an extended magazine, left near the scene. He was also found with another gun when later arrested.

Milyak killed Alejandro Valle in the early hours of September 24 2016 in the Bayview. He was 17 at the time of the slaying and made a ward of the court after a 2018 juvenile adjudication for murder.

Valle’s friend Samantha Barillas paid tribute to him as a “very loving, caring, funny guy” at the time of his death.


Prosecutors say that SFPD officers came across Milyak, Joseph Carmona and Michael Carmona as they ran out of the building just before 4:00am on November 29 2024. Milyak is alleged to have fled the scene as a passenger in a Honda which then crashed, leading to his capture in a nearby street.

He was released pending further inquiries.

The next day a resident near the burglary location found an assault pistol underneath his parked truck. It is this firearm that was linked by DNA to Milyak in January 2025 – but an arrest warrant for gun possession was not inked until October 2025 and he was arrested on April 7 this year.

Prosecutors say he was found with a loaded pistol in his satchel when he was detained.


“The defendant poses a danger and he participated in a burglary with multiple accomplices, fled from law enforcement and possessed a loaded assault weapon which was discarded under a citizen’s car in public,” wrote assistant district attorney Rebecca Warren in a motion to detain.

She pointed out that he was also found with another firearm when arrested.

He was nevertheless released by Judge Dawn Payne on April 10 2026 and remains out of custody.


Milyak will appear today at San Francisco’s Hall of Justice for a preliminary hearing – at which a judge will determine whether the evidence is sufficient to allow the case to proceed to trial.

He has pleaded not guilty to burglary and a host of gun possession charges.
