Man accused of indecent assault on woman MUNI rider was on probation in carjacking case

A man accused of the atrocious indecent assault of a female MUNI rider, while he was on probation after carjacking a San Francisco senior, will appear in court tomorrow for a bail hearing.

Prosecutors say Luis Hernandez, 23, sat next to his victim on an otherwise empty bus on February 17 2026. The woman moved to another seat but Hernandez is said to have sat next to her again, before pulling her on to his lap, putting his hands underneath her skirt and molesting her.

“Upon review of the MUNI video,” wrote assistant district attorney Abigail Adams in a motion, “defendant is seen after the incident masturbating on the bus.”

Hernandez was arrested after the MUNI driver summoned police for help. He is also accused of battering the driver before he was placed into custody.

At the time of the attack Hernandez was on probation as a result of a 2024 felony carjacking case.

According to court documents, Hernandez took a Honda Accord owned by a 71-year-old man who was helping his elderly friend move some items in the Mission district.

The brave senior tried to his the thief with his cane but could not stop the car being stolen. It was driven away at high speed with the owner half-in, half-out of the front passenger window, only to fall out of the vehicle near the intersection of Folsom and 23rd Streets. His friend was also hit by the car, which was crashed four hours later in Redwood City and engulfed in flames.

The court was told the victim had pain in his body and legs after being dragged by the defendant.

He was promptly released on bail after that incident and would later be sentenced to probation which ran until September 2026.

Hernandez will appear Tuesday in Department 22 of San Francisco’s Hall of Justice for a hearing to consider a bail eligibility report and determine if he will be released again.

He has pleaded not guilty to felony false imprisonment, misdemeanor sexual battery, misdemeanor battery of a transit employee and misdemeanor lewd conduct.

The case continues.
